Breaking news: Akwa Ibom Court Nullifies Local Government Caretaker committee

Today, Hon. Justice Ezekiel Enang of Abak High court 1 ordered the dissolution of the constituted local government caretaker council in Akwa Ibom State.

While giving the judgment in a suit HA/26/2016, the court held that it was unlawful for the Governor of Akwa Ibom State to appoint persons as caretaker committee chairmen and members for the 31 local government areas of the state.

The Court also ordered the governor to immediately dissolve all the illegal constituted local government councils forthwith.

Briefing, newsmen after the judgment, Barr. Nsikak Akai of the NSIKAK AKAI & ASSOCIATES said the case emanated from his chamber and that it’s a private case.

“two (2) lawyers from my chambers were the plaintiff, we took the decision to challenge the action of the government at least for once to know if its lawful considering the constitutional provision, if the governor can wake up to say it must be caretaker in the case of having the choice of who represents them in the local government”

The Governor was sued with the Attorney General, who advise was the bases upon which the Governor acted.

The Government side was represented by the Barr. Uwemedimo Nwoko the Commissioner for Justice and Attorney General of the state.

Akwa Ibom State Governor, Mr. Udom Emmanuel, 4th July, 2017 inaugurated Transition Committees for Local Government Councils in the State with a charge on the Chairmen to operate a participatory government in their respective Councils.
