Court clears Onofiok Luke of rights infringement
Today the federal high court sitting in Uyo cleared the speaker of the Akwa Ibom state House of Assembly Rt.Hon. Onofiok Luke of allegations if rights infringement levelled against him by Dr. David Emmanuel Udo, represented by Inibehe Effiong.
It was alleged that the speaker instigated and supervised the beating and inhuman treatment on the applicant.
Riman J, held that there was no evidence by the applicant showing the speaker instigating or supervising the alleged infringement.
Also there was no evidence placing the speaker or his convoy or the said SSS official at the scene of the incident.
The court further held that the speaker cannot be held responsible for the gridlock as the applicant had already in his affidavit conceded that there was a gridlock on the road caused by a burial procession and not the speaker.
The court further held that paragraphs of the applicants affidavit were conflicting and therefore could not help his case.
On the whole, the court resolved all the issues in favour of the respondents and dismissed the case for lacking in merit.
Counsel for the applicant, Inibehe Effiong thanked the court for the judgement.
In like manner Ekemini Udim counsel for the 1st respondent thanked the court for the judgement which he said was in line with reality.
