Reaction to the Judgement of the Federal High Court in Dr. David Emmanuel Udo v. Rt. Hon. Onofiok Luke & 3 Ors
This statement is impelled by certain reports on social media touching on the personality of the counsel to the Applicant in relation to today’s judgment by the Federal High Court Uyo in the above mentioned case. We would have simply moved on quietly to our next line of action save for some mischievous attempts to cast aspersions on the counsel which are personal and goes beyond the Court judgment.
As legal practitioners and officers in the temple of justice, we respect the judgment of the Court, which held that Dr. David Emmanuel Udo, the Branch Chairman of the Nigerian Medical Association (NBA) in Eket LGA did not prove his case of fundamental right infringement against the Speaker of the Akwa Ibom State House of Assembly, Onofiok Luke, Mr Courage Noguese, the State Security Service (SSS) and the Commissioner of Police, Akwa Ibom State.
However, we strongly disagree with the judgement and we are of the respectful view that the judgment did not reflect the facts and evidence adduced in the case.
There are plethora of reasons why we believe that this judgment is against the weight of evidence, including medical evidence which we brought before the court. It is also our view that we were denied fair hearing.
Like I told the Court after the judgment, conscience is an open wound, and only the truth can heal it.
We do not intend to delve into the details of the various aspects of the judgment which we humbly feel are appealable at this point.
The Applicant, Dr. Udo, will consider appealing the judgment after we receive a copy of the judgment. We believe that the Court of Appeal shall vindicate us if this judgment is eventually tested.
As lawyers, we put in our best to ensure that justice was done to our client and we have no regrets whatsoever taking up this case.
The battle to end the culture of impunity by politicians and public office holders in Akwa Ibom State and Nigeria will continue.
